General Travel Terms and Conditions for Travel Contracts Concluded from 01.07.2018

1. Scope of the Terms and Conditions, Travel Registration, Booking Confirmation

1.1 These General Travel Terms and Conditions apply to all travel contracts of Lernidee Erlebnisreisen GmbH with a consumer according to § 13 BGB ("Customer"), concluded from 01.07.2018. The above-stated General Travel Terms and Conditions explicitly apply only to travel contracts concluded before this date.

1.2 By registering, the customer makes a binding offer to Lernidee to conclude a travel contract based on the travel description, the notices, and information in the brochure, and these General Travel Terms and Conditions. The registrant is responsible for all contractual obligations of co-travelers for whom they make the booking, provided they have assumed this obligation through an explicit and separate declaration.

1.3 The travel contract is concluded upon acceptance of the customer's registration by Lernidee. Lernidee informs the customer about the contract conclusion with a written booking confirmation on a durable medium (e.g., as an email attachment). If the content of the booking confirmation deviates from the registration, this constitutes a new offer from Lernidee. The contract is concluded under its terms if the customer accepts it within ten days through an explicit or implied declaration (e.g., payment of the deposit).

2. Payment, Travel Documents

2.1 After receiving the booking confirmation/invoice and the security certificate, a deposit of 20% of the travel price is due immediately. The remaining travel price must be received in full by Lernidee no later than 21 days before the start of the trip, provided it is confirmed that the trip will take place, particularly if it can no longer be canceled under section 7.1. Timely payment is determined by the crediting of the amount to Lernidee. The due date of the final payment is stated in the invoice/booking confirmation.

2.2 The customer must immediately inform Lernidee if they do not receive the necessary travel documents within the timeframe specified by Lernidee or if these contain incorrect information, especially regarding the customer’s personal details (name, date of birth, address).

2.3 If the due travel price is not paid despite a reminder and a reasonable deadline, Lernidee may withdraw from the contract and charge the customer withdrawal costs according to section 6.1.

3. Travel Formalities, Passport and Visa Requirements, Customer Responsibility

3.1 Lernidee informs the customer about general passport and visa requirements of the destination country, including approximate deadlines for obtaining visas, as well as health-related formalities (e.g., mandatory vaccinations and medical certificates) necessary for the trip and stay.

3.2 The customer is responsible for obtaining and carrying the necessary travel documents and ensuring their passport or ID card is valid for the trip. If the customer has commissioned Lernidee to apply for official documents/visas, Lernidee is not liable for the timely issuance and receipt of necessary visas by the respective diplomatic representation unless Lernidee has breached its own obligations and is responsible for the delay. Any fees charged by consular services for processing visa applications must be borne by the customer.

4. Services

The type and scope of the contractual services owed are derived from the program and service descriptions in the brochure for the respective trip in conjunction with the individual booking confirmation for the customer.

5. Price and Service Changes after Contract Conclusion

5.1 Lernidee reserves the right to unilaterally increase the travel price if the increase directly results from an unforeseeable increase in transportation costs due to fuel price hikes, increased taxes or fees for agreed travel services (e.g., tourist taxes, port, or airport fees), or currency exchange rate changes.

6. Customer Withdrawal before Travel Start

6.1 The customer may withdraw from the travel contract at any time before departure. If they do so, Lernidee loses its claim to the agreed travel price but may demand reasonable compensation.

7. Withdrawal by the Tour Operator

7.1 Lernidee may cancel the trip up to 21 days before departure if the minimum number of participants is not reached.

8. Customer Obligations, Complaints, Remedies

8.1 The customer must report defects immediately to the tour guide or Lernidee and request remedies within a reasonable timeframe.

9. Limitation of Liability

  • Lernidee’s contractual liability for damages that are not bodily injuries and not caused by negligence is limited to three times the travel price per trip and customer.
  • International sea transportation is subject to the Athens Convention and Regulation (EC) No. 392/2009.

10. Information on the Identity of the Airline

Lernidee is obligated to inform the customer about the identity of the operating airline(s) for all flights included in the booked travel.

11. Governing Law, Jurisdiction, and Data Protection

  • The contractual relationship between the customer and Lernidee is governed exclusively by German law.
  • Personal data is processed in compliance with German data protection laws.
